I applaud the fact that Kendall Coffey, who heads the legal team for Elian's Miami family, has brought in Judicial Watch to help in the legal battle on behalf of Elian.
But it must be remembered this is not just an eleventh hour move by Coffey, it is like one minute to midnight for little Elian.
If the legal actions to save Elian fail, all the blame lands squarely on Coffey's shoulders, since he threw the case at almost every step.
As I understand it, the strategy is for Larry Klayman and Judicial Watch to proceed in the trial court here in Miami, with Team Coffey proceeding with its appeal in the U.S. Supreme Court.
That strategy, repeatedly confirmed by Klayman to me, makes the following excerpt from today's Washington Post very odd.
The Post quotes Coffey:
Asked what recourse the relatives would have if the high court does not act, Kendall Coffey, an attorney for the relatives, said in Miami: "If the injunction is not granted by Wednesday at 4 p.m., our assumption is that there is nothing that will prevent the child from being immediately
moved to Cuba."
Why is Coffey not willing to tell the national media the rest of the strategy? Let Castro make the assumption the boy is being returned forthwith. Coffey should have noted that an action was also being taken with the lower court.
