Miami attorney Jack Thompson has chronicled on NewsMax.com the unbelievably pathetic way lawyers for Elian's Miami relatives have handled the case.
The legal team in Miami is led by Kendall Coffey, a long time associate of Janet Reno.
Yesterday, Coffey filed the team's appeal to the full 11th Circuit.
We asked Larry Klayman of Judicial Watch for his view of the document. "Very disappointing," he said.
Klayman was surprised the document relied so heavily by making an argument using the Chevron case. "It deserved maybe 2 pages of the 16 page brief, not half of it," Klayman said.
Klayman was surprised that the document made no mention of documents his Freedom of Information suit has uncovered. The documents show that the Clinton administration and the INS were working hand-in-hand in returning Elian.
Klayman said INS claims they created a "policy" that children are not allowed to petition for an asylum hearing are bogus. The documents show that in fact the INS action was not a policy implementation, but the result of a political deal between the Clinton administration and Castro.
Klayman also said he was surprised by the legal team's use of Kirkland & Ellis to write the appeal document. The firm is known for their ties to the Democratic Party.
